BOOKING TERMS AND CONDITIONS
Please read the following “Booking Terms and Conditions” carefully, as they contain important information about your legal rights, remedies, and obligations. You must not make any booking unless you understand and agree with the following Booking Terms and Conditions.
By making any booking, you agree to comply with and be bound by these Booking Terms and Conditions. These Booking Terms and Conditions apply to any bookings you make with our travel advisors by any means including via any booking platform, online, over the phone, by email, or in person.
We will rely on the authority of the person making the booking to act on your behalf and on behalf of any other traveller on the booking (regardless of whether other travellers have made separate payments) and that person will bind all such travellers to these Booking Terms and Conditions. You are liable for all bookings (including any hotel room charges, property damage) made by any of your representatives in connection with your account with us and whether or not they are appropriately authorised to make such bookings and we are not required to enquire as to the authority of any of your representatives to make bookings on your behalf.
OUR ROLE AS YOUR AGENT
World Travel Professionals Pty Limited (ABN 92 080 629 689) and worldtravel.com.au Pty Limited (ABN 36 065 317 517), trading as Orbit World Travel (Orbit).
Agency only. Orbit acts solely as an agent for the Principals. Your contract for each travel service is directly with the relevant Principal, whose own terms and conditions apply to your booking (including any conditions of carriage, change/cancellation rules, and liability limits). We do not control the acts/omissions of Principals.
Consumer guarantees. Nothing in these Terms limits any non‑excludable rights under the Australian Consumer Law (ACL). Where services are not supplied with due care and skill, remedies may be available under the ACL.
No guarantee of performance by Principals. We will exercise reasonable care and skill in arranging services, but we do not guarantee the performance of any Principal and are not liable for their acts/omissions, subject to the ACL.
QUOTES, PRICES AND AVAILABILITY
Dynamic pricing. Prices are subject to change until paid in full and tickets/vouchers are issued. Currency fluctuations, supplier price changes, taxes/fees and surcharges may change total costs.
What’s included/excluded. Your quote confirms inclusions. Anything not expressly listed is excluded (e.g., resort fees, city taxes, seat selection, baggage, visas, health tests, incidentals).
Errors. We reserve the right to correct bona fide pricing or availability errors.
DEPOSITS, PAYMENTS AND INVOICING
Deposits & due dates. We will advise deposit and balance due dates. Unpaid balances by the due date may lead to automatic cancellation by the Supplier(s), subject to their penalties.

If you choose to save your credit card details with us, they will be securely stored and may be used for your future transactions with us (including transactions agreed over the phone or by email). You can choose to remove your saved credit card details at any time.
Some fares or packages may be payable directly to a Supplier by credit card.
Hotels. Credit card payments made directly to hotels may incur additional merchant fees. Local taxes and surcharges may apply to hotel bookings. These charges may not be included in the daily rate quoted on your itinerary.
Car Hire. Please note that additional taxes and surcharges may apply for car hire. An example of these surcharges may be - road tolls, additional kms/miles (if limited), premium airport location surcharge, satellite navigation system, child seats, vehicle registration recovery fee, loss or damage excess waiver fee and fuel. We recommend travel insurance for all car hire.
Chargebacks. By authorising card payment, you agree not to initiate a chargeback where services have been provided or where the dispute is otherwise addressed by these Terms, the relevant Supplier terms, or applicable law.
Trust arrangements. We operate a travel a client travel account to ensure safety of client funds.
ORBIT SERVICE FEES AND TRANSPARENCY
In addition to any Supplier charges, charges the following service fees:

FINANCIAL NOTES
CHANGES AND CANCELLATIONS
Voluntary changes. Changes after booking may be restricted or not permitted for certain fares/products and can incur Supplier fees plus Orbit service fees as outlined above.
Voluntary cancellations. Refunds depend on the fare/tariff rules and Supplier policies. Many discounted airfares and hotel rates are nonrefundable/‑non-changeable.
No‑shows & unused services. No-shows are typically non‑refundable. Unused services are not refundable unless the Supplier rules allow it.
Refund timing. If a refund is due, it’s paid after funds are received from the Supplier(s). Airlines and other Suppliers may take a significant time to process refunds; this is outside our control.
CHANGES, DISRUPTIONS AND CANCELLATIONS BY SUPPLIERS
Schedules & connections. Airlines and other Suppliers may change schedules (including flight times/routes, equipment or crew) at any time. We’ll assist with options offered by the Supplier (e.g., rebooking, credit or refund per their policy), but final remedies are governed by the Supplier’s terms and any applicable law.
Consumer guarantees. The ACL provides guarantees for services to be supplied within a reasonable time. Your rights may include a remedy where delays/cancellations occur, depending on circumstances (e.g., whether within the Supplier’s control).
Force Majeure. If performance is prevented by Force Majeure, Suppliers may offer limited remedies such as credits, rebooking, or partial refunds per their policies; additional costs (e.g., accommodation, meals, alternative transport) are typically at your expense unless the Supplier agrees otherwise, subject to your ACL rights.
TRAVEL INSURANCE (STRONGLY RECOMMENDED)
Comprehensive travel insurance is strongly recommended at the time of booking to cover, for example, medical emergencies, evacuation, cancellations, delays, baggage, and personal liability. If you can’t afford travel insurance, you can’t afford to travel — this is consistent with official advice to Australian travellers.
PASSPORTS, VISAS, ENTRY/TRANSIT AND HEALTH REQUIREMENTS
Your responsibility. You are responsible for ensuring you have a valid passport, visas, transit permissions, vaccination/health documents and any other required entry/exit documents for all destinations and transit points.
Passport validity. All travellers must have a valid passport for international travel and many countries require at least 6 months validity from the date of return and some countries require a machine-readable passport. For international travel bookings, you must let us know if you have less than 6 months validity on your passport or if you do not have a machine-readable passport. When assisting with an international travel booking, we will assume that all travellers on the booking have a valid Australian passport which is valid for the relevant destination and transit point. If this is not the case, you must let us know. It is important that you ensure that you have valid passports, visas, ESTA (USA), ETA (Canada, New Zealand and the United Kingdom are some countries allowing travel via ETAs for Australian passport holders) and re-entry permits which meet the requirements of immigration and other government authorities.
Travelling to or transiting through the United States. Please see https://esta.cbp.dhs.gov/ for important information regarding compulsory pre-registration for their visa waiver program (“ESTA”). Australian passport holders will not be able to enter the United States without a valid ESTA (or visa). Please note, you may not meet the eligibility requirements of ESTA and may be required to obtain a visa. Note that if you have travelled to certain countries (including Iran, Iraq, Syria, Sudan, Yemen, Libya, Somalia, Cuba or North Korea) then you will likely not be eligible for the United States visa waiver program (ESTA) and will have to apply for a U.S. visa (which requires an interview appointment and can take several months).
Travelling to or transiting through Canada Please see http://www.cic.gc.ca/english/visit/eta.asp for important information regarding compulsory electronic travel authorization for visa-exempt foreign nationals (“ETA”). Australian passport holders are not able to enter Canada without a valid ETA (or visa or permit). Please note, you may not meet the eligibility requirements of ETA and may be required to obtain a visa or permit.
Travelling to or transiting through Europe
Please see https://travel-europe.europa.eu/ees_en for important information regarding the new Entry-Exit System (EES). From 10 November 2024, The European Union is rolling out the new Entry-Exit System (EES). This automated system will require Australians to scan their passports and biometric data at self-service kiosks every time they enter or exit the EU. This is designed to tighten border security for non-EU travellers, including those from the United Kingdom.
Travelling to or transiting through the United Kingdom
Please see https://www.gov.uk/guidance/apply-for-an-electronic-travel-authorisation-eta for important information regarding compulsory electronic travel authorization for nationals who do not require a visa for short stays (“ETA”). Australian passport holders are not able to enter the United Kingdom on/after 8 January 2025 without a valid ETA. An ETA does not guarantee entry to the UK. Please note, you may not meet the eligibility requirements of ETA and may be required to obtain a visa or permit.
We urge you to apply for any of the above ESTA, EES or ETA prior to making a booking if you have any concerns about whether or not you might be eligible.
International Driver’s Licence. May be required if hiring a car.
Health & vaccinations. Some countries and Suppliers require specific vaccinations or health documentation. You must check the latest requirements well before departure.
Consequences. Denied boarding, refusal of entry, fines, quarantine, or costs resulting from non‑compliance with passport/visa/health requirements are your responsibility.
TRAVEL DOCUMENTS
Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a travel service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable, and/or subject to cancellation and/or other change fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. Your name on your passport, visa and other travel documents must all be identical. An incorrect name on a booking may result in an inability to use that booking, the booking being cancelled, and the application of additional change and/or cancellation fees. Please review your travel documentation carefully and advise us immediately of any errors in names, dates, or timings. If you have booked with a travel manager, it is your responsibility to collect all travel documents from us prior to travel. As a general rule your travel documents will be available for collection 2 weeks prior to your departure date, however this will depend on your individual arrangements. Please contact your travel manager to confirm when your travel documents will be ready for collection. If you have booked online, you should retain your electronic record or you should print out and retain your travel documents as provided to you by our website (or in a follow up email we send you). Please ensure you retain the most up-to-date version.
Please ensure you read your travel documents carefully for details on baggage allowances as these can vary from airline to airline and country to country. Excess baggage (if your airline allows it) can be expensive and is your responsibility. We will not be liable for any expenses, fees, penalties, costs, liabilities, damages, or losses associated with baggage allowances and excess baggage.
TRAVEL ADVICE, SAFETY AND RISK
Government travel advice. You should review and monitor official travel advice at Smartraveller for all destinations (including stopovers) before booking and up to departure. Orbit is not responsible for your decision to travel or for changes in government advisories. Smart Traveller offers 24hr consular assistance for Australian Travellers in emergencies.

High‑risk destinations. Insurance may be restricted or unavailable for destinations with “Reconsider your need to travel”/“Do not travel” advisories; travelling contrary to advice can void cover.
SPECIAL ASSISTANCE, MOBILITY AND MEDICAL CONSIDERATIONS
Disclosure. Please inform us before booking of any mobility, medical, or dietary needs so we can advise on feasibility and any documentation required. Supplier capabilities vary.
Pregnancy & infants. Airlines and cruise lines have specific policies, medical certificate windows, and cutoff dates. You must check and comply with‑ these rules to avoid denied boarding.
BAGGAGE, CHECK‑IN AND SUPPLIER RULES
Baggage. Baggage allowances, prohibited items, and security rules vary by airline/route/cabin. Excess baggage and special items may incur fees.
Check‑in. You must comply with checkin, reconfirmation and minimum connection times. Missed flights due to late arrival at the airport or tight self‑-connected‑ itineraries are at your risk.
PRIVACY AND DATA PROTECTION
Collection & use. Orbit collects, uses and discloses personal information to arrange your travel (e.g., providing data to airlines, hotels, tour/insurance providers, GDS/booking platforms). We handle personal information in accordance with our Privacy Policy and the Australian Privacy Principles (APPs) where applicable.
Cross‑border disclosures. Your information may be transferred overseas where Suppliers are located; we take reasonable steps to ensure appropriate protection consistent with the APPs.
Retention & security. We implement reasonable security measures and retain records as required by law and for legitimate business purposes. See our Privacy Policy for details and your access/correction rights.

LIMITATION OF LIABILITY AND INDEMNITY
To the extent permitted by law, Orbit is not liable for any loss, cost, expense, injury, or damage arising from acts/omissions of any Principal or from events beyond our control (including Force Majeure), except as required by the ACL.
You indemnify Orbit for losses arising from your breach of these Terms, wilful misconduct or misuse of services, except to the extent caused by our own negligence or breach of the ACL.
COMPLAINTS AND DISPUTE RESOLUTION
Talk to us first. If you have concerns, please contact us promptly with booking details and supporting documents. We’ll investigate and respond.
Escalation. If unresolved, you may escalate to ATIA/ATAS or to the relevant state/territory consumer protection agency.
Non‑economic loss. In some cases, limited compensation for disappointment/distress may be available via industry schemes or under the ACL; outcomes vary by case.
Governing law. These Terms are governed by the laws of Queensland or NSW, and the parties submit to the non‑exclusive jurisdiction of its courts.
FINANCIAL PROTECTION AND SUPPLIER DEFAULT
Supplier insolvency. If a Supplier becomes insolvent or fails to provide services, remedies (e.g., chargebacks, credits, insurance claims) depend on the circumstances and your coverage; Orbit will assist where possible but is not responsible for the Supplier’s default, subject to the ACL
INTELLECTUAL PROPERTY
Our website/content, itineraries, and materials are protected by intellectual property rights. You may use them for your trip planning; other use requires our prior written consent.
VARIATIONS TO THESE TERMS
We may update these Terms from time to time. The version applicable to your booking is the version in force on the date you pay your deposit or otherwise accept our quote.
